Natasha Chell has written for Free Movement on a developing Home Office practice affecting the Skilled Worker route: cancellation action following the end of sponsored employment appears to be happening more quickly than many sponsors and workers may previously have experienced. Her article, ‘Faster cancellation of Skilled Worker permission demonstrates the enforcement grip is tightening’, explains that, in the past, there could be a lengthy interval after a sponsor notified the Home Office that a worker’s role had ended before any cancellation action was taken. By the time the Home Office acted, the worker may already have moved onto a new immigration route or their permission may otherwise have come to an end.

The article identifies signs that this approach may be shifting. Drawing on recent examples, Natasha explains that the Home Office has acted much sooner after sponsors submitted end of sponsorship reports, including one case where action followed a little more than three weeks later.

For sponsors, this is a significant compliance development and makes accurate, timely sponsorship management system reporting even more important. Sponsors should also consider the impact on workers whose employment has ended, as the period available to secure a new sponsor, make another immigration application or leave the UK may now be shorter in practice.
