Solicitor James Clark has been quoted in a new article by Global Mobility Lawyer on how technical issues with eVisas are preventing individuals from being able to prove their right to travel to and live in the UK.

The piece details how technical issues with the digital immigration system can cause significant issues for travellers and those needing to prove their right to live and work in the UK, focussing on the recent case of an EU national with status under the UK’s EU Settlement Scheme who was stranded abroad when her eVisa record became ‘entangled’ with that of her twin sister.

In the article, James details how:

“We have seen a number of cases of clients struggling to prove their UK immigration status to airlines, leading to individuals being unable to travel. While such cases are statistically rare, they continue to happen – this may, at least in part, reflect training or awareness issues among airline staff.”

Addressing travel delays and eVisa issues specifically, James elaborates:

“We are continuing to see delays in the setting up of eVisa records following approval of a migrant’s visa application. If a migrant needs to travel urgently – for example, to start work in the UK – such delays can cause real issues, particularly where they persist for several weeks.

As eVisas have now largely replaced physical immigration documents for most visa holders, there is limited scope for an alternative means of evidencing status if there is a failure in the Home Office’s eVisa system, which presents a significant vulnerability for travellers and mobile workers.”
